Township Officials Confirm Smith v. Galloway Twp Agreement was Released to Media Without Formal Council Approval


GallowayTwpNews.com has obtained through an Open Public Records Request the Settlement and Release agreement pertaining to the Jody Smith v. Galloway Township et al. litigation. The agreement was already released to Galloway Township Patch Editor Anthony Bellano in response to an OPRA Request he filed.

GalowayTwpNews.com reviewed the agreement and previous agenda's and determined the Township did not vote on the agreement, nor did Mayor Don Purdy execute said agreement released by Township Clerk Thalia "TC" Kay today.

Councilman Jim McElwee confirmed the settlement agreement has not been formally presented to Council for a vote. 

Mayor Don Purdy confirmed same and added the terms also have not been fully presented to Council. Purdy declined further comment since the litigation has yet to be settled.

Request for comment by Township Manager Arch Liston as to whether the Township will recall the released documents went unanswered at the time of publication.

Kay did state in an email that "the Resolution is on the agenda for Tuesday, February 12, 2013 at 6:30 p.m." We requested explanation from Township Clerk TC Kay as to how an agreement that has not been approved by Council could be released. We did not receive a response from Kay on that questions by time of publication.

Sebastian Ionno, Esq, who represents Jody Smith was reached for comment, however declined to answer questions due to the confidentiality of the pending settlement. Ionno was provided with a copy of GallowayTwpNews.com OPRA Request and email correspondence in reference to the release of the agreement. 

Due to the fact the agreement and terms have yet to be formally discussed by Galloway Township Council and in our opinion, should not have been released by the Township, GallowayTwpNews.com will not be releasing the agreement nor the terms of the agreement until formally reviewed and approved by Council.

Arresting / Investigating Officer: Ptl. S. Vernon #83

Ms. Oliver-Allamong reponded to the above incident location to aid her sister who was having a dispute earlier in the day.  Allamong arrived with a loaded .22 caliber handgun in her possession.  Police received a 911 call stating that there was a dispute and a woman was loading a handgun.  Allamong was arrested and charged with possession of a weapon for unlawful purpose.  She was lodged in the Atlantic County Justice Facility in default of $20,000 cash bail.  There were no injuries sustained.

UMDNJ to Give Kids A Smile!® on February 1
In Newark, Scotch Plains, Northfield, Somerdale, Galloway Locations
One-day event held in Newark, Scotch Plains, Northfield, Somerdale, and Galloway locations allows dental professionals to treat underserved children, ages 12 and under, at no cost to their families.

Cleanings, fillings, fluoride and sealant treatments and basic oral health education will be provided to hundreds of children ages 12 and under at several New Jersey sites by the University of Medicine and Dentistry of New Jersey (UMDNJ) on Friday, Feb. 1, during Give Kids A Smile!® (GKAS) National Dental Access Day.

It is the 11th year that UMDNJ has participated in GKAS, a national initiative held each February by the American Dental Association to focus attention on the epidemic of untreated oral disease among disadvantaged children.  GKAS provides free oral health education, screening and treatment services to children from low-income families across the country that, for a variety of reasons, may not have regular access to such services. The event is an annual centerpiece to National Children’s Dental Health Month. Last year, more than 4,600 children across New Jersey were given a wide range of dental services by dentists, hygienists and dental assistants.

GKAS will be held at the following UMDNJ locations:

·         UMDNJ-New Jersey Dental School in Newark, 9 a.m.–1 p.m.;
·         University Dental Center at Galloway, 9 a.m.–noon
·         University John H. Cronin Dental Center at Northfield, 9 a.m.–noon
·         University Dental Center at Somerdale Square in Somerdale, 9 a.m.–noon
·         UMDNJ-School of Health Related Professions in Scotch Plains, 10 a.m.–1 p.m., and 2 p.m.–5 p.m.
UMDNJ’s students and faculty have volunteered for GKAS each year since the initiative’s inception in 2003.  In 2012 alone, the University’s sites saw a total of more than 400 children. UMDNJ-New Jersey Dental School in Newark is one of the two largest sites in the nation. Working with public elementary schools, charter schools and Head Start providers, UMDNJ has provided free dental services to more than 7,500 children during the past 10 years.

Last year, New Jersey’s program was the second-largest in the country, with 112 locations throughout its 21 counties. A total of 3,099 dentists, auxiliary personnel, students and staff members helped with the 4,602 children that were seen. More than 724 cavities were filled and 863 emergency or restorative procedures were performed. And for the first time the New Jersey program topped the $1 million mark in a single year, providing $1,210,464-worth of services or an average of $263 per child.

Township and Richard Stockton College to Begin Discussions on New PILOT Agreement for Stockton Seaview Hotel


GallowayTwpNews.com is the first entity to report that Township Officials have now confirmed discussions will commence in the upcoming weeks between Galloway Township and Richard "Stockton" College. The $300,000 PILOT Contribution made by Stockton College over the past three years will now expire in 2013. Without a new agreement the Township will begin 2014 with a $300,000 guaranteed deficit.

Township Manager Arch Liston and Mayor Don Purdy have both confirmed that the Township will begin discussions with Stockton College in the upcoming weeks. However, Liston and Purdy would not confirm if the Township will seek the same monetary contribution amount for the new agreement. 

Request for comment from Stockton College official Charles Ingram went unanswered at the time of publication.

In December 2010 the Township and Richard Stockton College entered into a three (3) year agreement for Payment In Lieu of Taxes. The agreement as released below states Richard Stockton College will make a $300,000 payment to the Township by March 1st of each year. The agreement included years 2011, 2012 and 2013. 

A stipulation in the agreement states, "Galloway and Stockton will reevaluate this Agreement prior to it expiration and shall discuss the appropriate contribution to be made in future years based upon the nature of the activities being conducted at Seaview. Stockton's financial situation at the time, and the municipal resources used by Stockton, as well as the services provided by Galloway."

Stockton College has their own Police Department, however at the time of discussions with the Township in 2010, Township Officials were concerned about other Township services Stockton Seaview would be utilizing. Those services included the Township Fire Company and Galloway Police Department on calls for service. Township Officials including former Mayor Keith Hartman and then Deputy Mayor Don Purdy meet with Stockton Officials for two hours in September 2010 before the $300,000 contribution was agreed upon. 

Stockton purchased Seaview Hotel and converted multiple rooms into dorms for some of their elite students that would participate in the Hospitality Program with the College. Stockton also spent millions of dollars in renovations before hosting their first LPGA Tournament. 

Stockton also has another PILOT agreement with the Township for residential houses they own within the Township.

We are confident with the relationship between the Township and Stockton College, that they both understand even in these tough economic times a new agreement with a similar amount is needed for future years.

Galloway Awarded $230,000 Grant from NJ DOT for Safe Routes to School Program for Collins Road


(Trenton) – The Christie Administration today announced Local Aid grants totaling $530,000 for two Atlantic County municipalities. The Atlantic County grants are among 35 Local Aid grants totaling nearly $6.8 million supporting local road and safety projects.


·         Egg Harbor City will receive a $300,000 Safe Routes to School grant for its Pedestrian and Bicycle School Access Program.


·         Galloway Township will receive $230,000 through the Safe Routes to School program for pedestrian safety improvements on Collins Road.

The entire package includes ten state-funded Local 
Aid Infrastructure Fund (LAIF) grants totaling $1.1 million for emergency road repairs and 25 federally funded Safe Routes to School grants totaling $5.7 million for sidewalk, intersection, crosswalk and other improvements to help children remain safe as they walk or ride bicycles to and from school.

These grants are among hundreds distributed by this administration every year to help local and county governments advance essential projects without burdening local property taxpayers,” NJDOT Commissioner James Simpson said.  “Local Aid grants are funneling $380 million in state and federal funds to support worthy local projects and planning initiatives in the current fiscal year.”

The Local Aid Infrastructure Fund generally supports unanticipated expenses, and this round of grants includes funding that will supplement Federal Emergency Management Administration grants related to damage caused by Hurricane Irene in 2012.

The Safe Routes to School grants are awarded on a competitive basis. Today’s announcement of the 25 grants will be provided to the recipients as their projects advance.

According to Township Manager Arch Liston, the Township will still need to go through design and then bidding of this project for Collins Road. The first phase which including improvements along Wrangleboro Road was delayed due to the Township needing to obtain easements from property owners. Liston also stated the Township looks at no costs coming from the Township.

Police Arrest Female Suspect in Third CVS Robbery in Smithville


On January 24, 2013 at approximately 948am patrol responded to the Smithville CVS Pharmacy for an armed robbery.  Store personnel advised a female entered the store walked to the pharmacy counter and demanded pills and money.



The suspect displayed what appeared to be a handgun inside a plastic bag.  She then fled the store. A search of the immediate area was conducted by arriving Patrol Officers, Detectives, and K9 (Ofc. Welsh and K9 Partner Titan).
The track led to Waterview Dr. Building 21 where a suspect, who matched the description, was located and subsequently taken into custody by officers on scene without incident.
Arrestee-Deborah Conover 48 year old female of Galloway Township was transported to the station where she was processed and charged with 3 counts of armed robbery, which include the robberies that occur in the same CVS store on 12/29/12 and 1/8/13.
She was lodged in the Atlantic County Jail in default of $250,000 cash bail.

Closed Post Office Building Now Becomes Home to the Historical Society

Just about a month after the Township's Post Office closed it doors for good, Council will re-open the doors and allow the Township's Historical Society to move in. The Historical Society which was created by Ordinance in 1987, is recognized as an official agency of the Township.

According to the Township ordinance, the Historical Society has the responsibility of researching, preserving and maintaining information and memorabilia relating to the establishment, growth and development of the Township. The Township must also give consideration in the annual budget in order to support the work of the Historical Society. 

The historical society lead by Robert Reid will begin to transfer items from the Township's current Historical Room which is located within the Township complex to their new building just a couple feet away. 

The old post office will still be occupied by the Township's GTV television station as well as offices that are located on the second floor. The Historical Society will only take up a portion of the main floor.

Ken Sooy Sr., the Town Historian requested anyone from the public who may have historical pictures or artifacts can either come to an open house where the items will be reviewed and copied or they can contact Sooy directly. Sooy provided his home number (609) 652-7844, cell number (609) 442-1969 and his email address: sooy999@yahoo.com, for anyone from the public to contact him regarding the Historical Society.

The Historical Society holds an Open House at the Municipal Complex every 2nd Saturday of each month from 10:00 a.m. to 3:00 p.m., unless otherwise listed. The next open house is February 9, 2013. Everyone is encouraged to attend.

Council Tabled Resolutions for Invocation Policy and Accumulated Leave Payout for Bonanni & Gougher


Galloway Township Council tabled three resolutions that have become the center of public scrutiny in the past few weeks. Former township manager Stephen Bonanni and CFO Jill Gougher will have to wait until the next scheduled council meeting to find out if the Township will approve resolutions authorizing payment for their Accumulated Sick and Vacation Leave which totaled $94,855.67.

A resolution that would have approved a new Invocation Policy was also tabled at the request of the committee which is chaired by Deputy Mayor Tony Coppola.  Coppola requested additional time in order to clarify wording in order to state Council members will not be mandated to say a prayer. Previously released by the Township were 26 pre-selected prayers that would be used on a rotating basis and approved by the Township Solicitor. The resolution has been rescheduled for the next regular Council Meeting on February 12, 2013. 

The other two resolutions would have approved payment for Accumulated Sick and Vacation Leave for both Bonanni and Gougher. The reason for those resolutions to be tabled, according to Mayor Don Purdy, was to have Township Manager Arch Liston take another look at the numbers. The resolutions were previously scheduled to be approved on Council's Reorganization agenda. They were removed at that time in order for Labor Counsel to review the payout amounts.

Gougher who resigned in October 2011, was anticipated to receive her second payment of $21,545.23 in the year of 2013. Gougher is due her final payment according to a pre-approved payment schedule, of $21,545.20 in the year of 2014. 

Bonanni who resigned in January 2012, was anticipated to receive the balance of his payment this month. However Bonanni will now have to wait until February 12, 2013 to find out if he will receive his final balance of $51,765.24.  Bonanni was the only employee who had a specific provision in his Memorandum of Understanding which would guarantee his Sick time to be protected if legislation was ever passed capping Sick Leave payouts by municipalities.

Council Agenda Includes $94,000 Accumulated Leave Payout to Bonnani & Gougher and a New Invocation Policy

Highlights of Council's Agenda includes Resolutions that would authorize accumulated leave payment to former Township Manager Stephen Bonanni and former CFO Jill Gougher as well as a resolution to adopt a New Invocation Policy. 
Township Manager Arch Liston confirmed in an email that both resolutions listed on the agenda in reference to the Accumulated Vac & Sick Time for Managerial Employees, not only pertain to Bonanni and Gougher, but also contain the same amount previously released by the Township and later reported by GallowayTwpNews. The balance to be paid on both employees equals $94,855.67. 
A resolution to Adopt a New Invocation Policy is also listed on the agenda. Over the past several months, Council has opted to lead the Council Meetings in a Moment of Silence instead of by Invocation which was adopted originally in 2010. After speaking with Mayor Don Purdy, it is anticipated this new policy of pre-approved selected prayers will most likely be adopted. 
We submitted an email to Township Solicitor Michael Fitzgerald voicing our concern over the new proposed policy and how the policy could potentially in our opinion be in violation of an Eleventh Circuit District Court Decision of Crowe vs. Cobb County, Georgia. 
Fitzgerald responded by stating, "First, this decision, which is from another Circuit and not the Circuit in which New jersey is located, as I read it does not prohibit a body from having approved prayers. Second, it might be legal to have a mix of clergy give sectarian prayers,  but the courts disagree on this and having such a policy potentially opens the Township to litigation. Also, having an appropriate mix of clergy can be difficult to implement  and municipalities have been challenged on their selection process.  Third, nothing in this area is entirely settled or entirely clear, but I believe that Council’s approach addresses the prayer issue in a sensitive manner and minimizes the legal exposure."
In our response to Fitzgerald we stated, "It is my understanding case law from other Circuits can be used in New Jersey and considered as Persuasive Law, not binding on the jurisdiction. The degree of reliance would be pending on the absence of law in that jurisdiction."  
It is my opinion, Council approving a pre-selection of prayers may in fact violate the Establishment Clause. By Council approving a policy that contains a selection of prayers, Council would not only be restricting religion, but also endorsing certain faiths and religions.
The new proposed policy may easily be challenged as all faiths may not be represented in the selection. It is also my opinion, by Council approving the pre-selection of prayers, may also in fact violate Marsh v. Chambers in the Crowe v. Cobb County decision as the the court affirmed, they "refuse to embark on a sensitive evaluation or to parse the content of a particular prayer. Whether invocations of "Lords of Lords" or the "God of Abraham, Issac and Mohammad" are sectarian is best left to the theologians, not courts of law." If the court ruled they would not interfere, than why would Galloway Township restrict a policy that specifically does what the courts would not. 
I agree this is a sensitive issue for everyone and maybe some specifically, but why is Galloway Township changing a policy that could have been held up in court, more so than the new proposed policy. The Township could face litigation for the mere purpose of challenging the selection of prayers with Council approval which is more restrictive than an open invitation to all faiths and religions to provide an invocation on a rotating basis as already approved." 
Galloway Township Council Meeting is Tuesday January 22, 2013 at 6:30 p.m. located in Council Chambers. 
We will report on Council's decisions and post the new Invocation Policy if the Resolution is adopted by Council.

On 01/06/2013 Clifford Lepage, 68, of Pennsylvania was arrested by Ofc. Vincent Ceci for DWI following a motor vehicle stop.  He was released on a summons.

On 01/06/2013 Charlee Thomas, 32, of Bridgeton was arrested by Ofc. John Mooney for Possession of a Controlled Dangerous Substance (marijuana under 50g) and Possession of Drug Paraphernalia following a motor vehicle stop. She was released on a summons.
